  • Samsung's Closing Arguments in the Apple vs. Samsung Trial

    The Apple vs. Samsung trial which has taken place in California over the past few weeks is finally coming to an end with both companies making their closing statements to jurors yesterday. We shared Apple’s closing arguments previously and now we’re going to discuss Samsung’s closing arguments. After Apple finished its closing arguments in the trial, it was Samsung’s turn to close its case. The South Korean electronics manufacturer took the stance that Apple was trying to mislead the jury and that Apple couldn’t prove that Samsung had copied its products and that customers didn’t really get confused over Apple and Samsung products either.

    Samsung’s Charles Verhoeven started off by trying to explain that Apple is trying to go for a bigger target than the $2 billion it thinks it deserves. In fact, he shared his belief that Apple is trying to win the case to leverage itself in the smartphone and tablet market by blocking Samsung from it. Verhoeven continued to discredit key Apple witnesses including Susan Kare and Apple expert Russel Winer, saying both witnesses admitted that they could not provide any evidence when asked for it. At this point, Samsung tried to pinpoint differences in all of its devices, even showing the startup screen of its Galaxy Tab, explaining “you see Samsung Galaxy Tab for a long time. Then it has Verizon.” The company was obviously trying to show that customers can make the differences between the devices.

    Moving on, Verhoeven addressed the emails and documents that showed Samsung executives discussing the iPhone by saying “that doesn’t show copying. It’s a company trying to figure out what’s going on.” This is when Verhoeven tried to explain that Apple is trying to mislead the jury. Samsung’s big takeaway quote here was when Verhoeven made a comment trying to portray the good of Samsung:

    “There is no bad intent. There is no copying. … Samsung is a good corporate citizen. All it wants to do is make products that consumers want. … All this copying evidence is hand-waving by Apple. Why? Because they don’t have anything else.”
    As time continued to wind down, Samsung began to rush its closing arguments to save time for later rebuttals. Verhoeven wrapped up by claiming that Apple’s financial expert, Terry Musika, wrongly calculated the amount of damages that Samsung owes. The South Korean company says that Musika didn’t take into account sales, costs for advertising, costs for research and development, or allocated operating costs. The lawyer went on to say that he doesn't think Samsung should have to pay any damages. His last quote for the closing argument was “We hope you don’t get there, but if you do, you’ve got to use your common sense.”

    With both sides having finished their closing arguments, we’ll have to wait and see what happens next.

      So in closing, Samsung doesn't state they didn't copy in their losing argument. If they would have worked with Apple in the first place, like Microsoft did ( because Microsoft recognizes the patents) this could have been avoided. USA! All you American Droid boys should be ashamed, support a USA company dumb $/@;$'s.

      You mean that USA company that ships jobs out of the country by outsourcing the production of everything? The same company that, although is among the most profitable companies in the world, is still laying off what little employees in USA they have??? If you wanna say "support a USA company" at least make sure it's a company that both designs & manufactures in the USA. IMO designing something here in America & having it manufactured in another country diminishes the fact that it's an American company

      Dirty tactics? Like Samsung not showing a full video, basically clipping it, like Samsung releasing photos after being told not to, like Samsung living throughout the trial, Samsung has shown throughout the trial their true self, liars and deception. USA!

      Think it through dpimple, the profits stay in the US, yes jobs are outsourced, that's only because greedy unions here in the US tie our hands. Bottom line, the profits are here in the US, not in Asia. Read about Korea and their philosophy, they only buy their brands, if not available they buy USA products, then last Asian, what does that tell you. Think before you type.

      Lol the money apple is paying to outsource production stays here?? That is not true! Also why would one of the most profitable companies in the world lay off a good chunk of USA retail employees when that accounts for most of your USA workforce? Where the patriotism there? Apple is not a patriotic company! They are a cut throat company that will sacrifice dignity, human rights, & USA jobs for as much of a profit margin on their products as possible. This coming from an owner of 2 iPhones!

      Apple don't know how to play nice and like to bully their way into things. As he said

      I've always said that and always will as Apple like to play dirty and sue Samsung instead of making a better device.

      Again, I really hope Samsung win and make Apple pay. They deserve it.

      ALL big companies outsource...HELLO people this is not news at all. Think about Mexico, China and other places that American business' outsource globally. Its called making money haha! If you buy lemons and make lemonade to sell, would you hire workers at $10 or would you find workers that are willing to do it for $2.50?? Anyway.

      No the money being shipped is lost. But the profit is for the USA. You see apple ships the products all over the worlds and sells them. THEY EVEN SELL THEM BACK TO CHINA. You see a Chinese worker would have to work for months on months to amount to an iphone. And probably assemble hundreds of iphones before they could afford one. Apple sells its products in 6 continents and the VAST VAST majority of profits end up home, in Cupertino, California. The untold BILLIONS Apple pays in taxes for this is crazy. In closing, f*** you. Apple is patriotic.

      Apple didn't "lay off a good chunk of USA retail employees." They did adjust hours and work schedules for some part time employees under their new retail manager, but he realized his mistake after the bad press and rescinded the changes. Apple has consistently received high reviews for their retail stores and from their employees.

      Almost ALL R&D on Apple products is done here in the U.S. and Apple is opening data centers around the country to support iCloud and online services. As for Apple manufacturing compared to Samsung, where do you think Samsung phones are put together? In China, just like Apple, Motorola, and Windows smartphones.

      This case is pretty open and shut, Apple developed and perfected the touchscreen smartphone w/o a physical keyboard and Samsung, Motorola, Google and even Microsoft copied them. Samsung's copying is especially egregious due to their inside knowledge of Apple's products as a supplier of chips and screens. Their counter claims of copyright infringement are just smoke and mirrors trying to detract from the basic copying charges.

      Samsung obviously copied Apple's iPhone (all 3 designs) and iPad (both 2 designs), so did others. It's true that Samsung copied them to the extreme. However, what really matters is -- is it realistic to fully allow copying? Do you realize how much more all customers would end up paying if this type of copying is totally prohibited? That's unimaginable!!!

      Blame the greedy unions? Give me a break. Look at the combined wages of all the union laborers and compare that to the senior execs. You can't and shouldn't blame a worker for wanting a yearly wage that's actually less than what many of the top executives make in a single day.

      As far as outsourcing goes, look to our government for a lot of that. Corporate tax breaks are a good thing. They keep companies on our soil, which means more jobs (more taxes collected) and more spending (again more taxes) which keeps the economy moving forward.

      The discussion between Jobs and Obama on moving the assembly back was pretty interesting - google it - but the bottom line is that it'll never happen. Too much red tape.

      If blatant copying is allowed,there is no incentive to invest in R&D and we'd still be using Motorola bricks...
