  • Lawsuit Against Apple Regarding Overheating iPad was Dismissed


    On the heels of news that Apple may be in the process of provoking an anti-trust dilemma over the company's new App Store subscription policy, Apple is off the hook with regard to another lingering legal matter involving the issue of overheating iPads. According to a report Wednesday morning from our friends at Computer World, the lawsuit in question has effectively been dismissed.

    The complaint was filed as a class-action lawsuit last summer and steeped in the argument that Apple failed to properly caution iPad owners about the tendency of the tablet to overheat when used for a sustained period in direct sunlight. While most iDevice users and even casual consumer electronics users are well-aware of the likelihood of mobile gadgets overheating in sunlight, the complaint reads: "Using the iPad is not 'just like a reading book' at all since books do not close when the reader is enjoying them in the sunlight or in other normal environmental environments."

    U.S. District Court Judge Jeremy Fogel, however, ultimately decided to toss the complaint and the class-action lawsuit on grounds that the argument lacked specificity. "The Court concludes that these allegations are insufficient," Fogel wrote in his order. "At the least, Plaintiffs must identify the particular commercial or advertisement upon which they relied and must describe with the requisite specificity the content of that particular commercial or advertisement."

      Sounds like Stupid Rednecks trying to make a quick buck!! I can understand them suing Apple if lets say ... the iPad exploded while you read in the sun ... or the battery started leaking ... but overheating ... comon ... its a NO-BRAINER!

      Rednecks? Please. Probably some overly sensitive spoiled yuppie that has no real clue of reality but thinks everything and everyone caters to his or her needs. Typical class action lawsuit"ist". Found a greedy lawyer to take the money and run.

      I think I'll have to agree with this one. It seems to me that rednecks make do with what they have. Have u seen those gator catching shows (?); their boats are literally duct taped together!!! Plus a redneck prolly has no use for an iPad...
      ....or a lawyer

      how ignorant can people get these days? of course if you use any electronic device in direct sunlight it will get hotter and potentionally overheat.

      isn't there an emergency shutdown when the ipad gets overheated anyway? i know iphones and ipods do.

      In this case the user was blind so the warning screen was not effective.

      When I first got my iPad I had that same problem. It was a hot summer sunny morning and I was outside showing off my iPad to my friends so I set it on the trunk of a car watching a movie smoking and blank goes my iPad. Feeling stupid in front of my friends I say off top the battery is dead knowing it said 100% before came out. While walking back to my house I pushed the home then power a caution sign popped up and said something like the device is too hot or whatever while I was in my house for about 3 min with the AC running it came on. Not a surprise cause my MacBook pro kept shutting down during the summer so I downloaded smc fan control and now it's really a mbp i7.

      I was thinking the same thing lol. Anybody that does not understand how electronics and heat work, should not be using an iPad anyways.
