  • Lawsuit Against Apple Regarding Overheating iPad was Dismissed


    On the heels of news that Apple may be in the process of provoking an anti-trust dilemma over the company's new App Store subscription policy, Apple is off the hook with regard to another lingering legal matter involving the issue of overheating iPads. According to a report Wednesday morning from our friends at Computer World, the lawsuit in question has effectively been dismissed.

    The complaint was filed as a class-action lawsuit last summer and steeped in the argument that Apple failed to properly caution iPad owners about the tendency of the tablet to overheat when used for a sustained period in direct sunlight. While most iDevice users and even casual consumer electronics users are well-aware of the likelihood of mobile gadgets overheating in sunlight, the complaint reads: "Using the iPad is not 'just like a reading book' at all since books do not close when the reader is enjoying them in the sunlight or in other normal environmental environments."

    U.S. District Court Judge Jeremy Fogel, however, ultimately decided to toss the complaint and the class-action lawsuit on grounds that the argument lacked specificity. "The Court concludes that these allegations are insufficient," Fogel wrote in his order. "At the least, Plaintiffs must identify the particular commercial or advertisement upon which they relied and must describe with the requisite specificity the content of that particular commercial or advertisement."

      "Reading on the iPads is just like reading a book"

      See that word in bold, that means the iPad is similar to using a traditional paper book, but it doesn't mean that it is in fact a book.

      Lawsuits like this make me think back to the one where a woman put her cat in the microwave to dry it after a bath and it obviously died a horrible death but she won the case because there was no warning against putting a living creature in a microwave.

      So rednecks could very well be classed as a race.

      Rednecks have nothing to do with this.

      It's some lowlife, bottom feeder, ambulance chaser who couldn't think of anything better to do and decided that "Things under the sun shouldn't get hot."

      Why don't we take those lawyers, drop'em in the middle of the Mojave desert and see if they get hot. If they manage to stay cool in 120 degree weather, then their suit should have merit.

      Once again, too many fcking lawyers. There should be a movement to disbar lawyers who bring on frivolous lawsuit.

      Class Action lawsuits are BULLSH!T consumers get nothing, lawyers get millions.

      If i bought a device that is supposed to be some kind of ebook-reader i would be pissed too if i couldn't use it in the sun.
      People buy tablets to take them anywhere. They show that in almost every apple ad. I can understand why apple has been sued, it just contradicts the whole tablet-thing alltogether.

      I don't know much about hardware but does the iPad have some kind of cooling at all?! It's not like you would hear a fan running like in my good ol' pc.

      please tell me you're not that narrow minded.

      ANY electronic device has a risk of overheating if left in the sunlight or in high temperatures for too long whether that would be an ipod, iphone, ipad, laptop, whatever. Just like staying out in the sunlight or heat for too long takes its toll on the human body. It's NOT just apple's products.


      And no it doesnt have a fan, but i bet someplace in the little booklet you get with most electonic devices it will state "DO NOT OPERATE IN EXTREME TEMPERATURES" or something similar.
