  • Fair Labor Association Releases Foxconn Report, Plenty of Violations Included



    The Fair Labor Association released a detailed report of their month-long investigation into Foxconn Thursday, and the report contains violations-O-plenty of FLA labor standards and Chinese workplace law.

    FLA auditors documented 50 different violations of FLA standards and Chinese workplace law including overtime hours of 80 per month compared to the 36 hours per month allowed by Chinese law. Foxconn has agreed to comply with FLA and Chinese standards concerning workers hours by July 2013.

    “During peak production, the average number of hours worked per week at Foxconn factories exceeded both the FLA Code standard and Chinese legal limits. This was true in all three factories. Further, there were periods during which some employees worked more than seven days in a row without the required minimum 24-hour break,” — FLA Report.
    Another part of the agreement is to establish a compensation package that will protect workers from lost income due to the reduced overtime hours. The FLA study spanned three of Foxconn’s factories (Guanlan: 73,004 workers; Longuha: 66,680 workers; Chengdu: 38,393 workers)
    and included over 35,000 anonymous surveys to help gain insight into the working conditions.

    Some notable findings from the survey include 64% of workers claiming that their wages didn’t meet their basic needs, with another 43% claiming they have witnessed a onsite accident.

    "Many of Foxconn’s health and safety violations, including blocked exits, lack of or faulty personal protective equipment, and missing permits have already been remedied. Additionally, Foxconn has agreed to change the system by which accidents are recorded. In the past, only those accidents that caused work stoppage were recorded as accidents. Moving forward, all accidents that result in an injury will be recorded and addressed," — FLA Report
    Foxconn has also agreed to improve worker and management relations through committees and other union structures. The current system is reactive and handles problems as they happen with little to no preventive measures or monitoring practices.

    Interesting tidbit, reading through the report some of the worst violations were committed at factories that make Xboxes. When was the last time Steve Ballmer visited one of Microsoft’s overseas manufacturing facilities?

      "64% of workers claiming that their wages didn’t meet their basic needs". Wow, and with all that over-time available too? That's some scary low-level-wages they must have there!

      Finally, some actual evidence of what goes on over there. I am tired of the ignorant people on this website that say "big deal, conditions are great compared to the rest of China", without having any real idea what it is like.

      I'd say that their supposed "basic" needs are not the very basic needs. Which would be shelter, sleep, food, and water. I think they are just complaining. It isn't that hard to satisfy basic needs. Even at their wages.

      LOL. That's funny, cause if you want to compare people about humanitarian efforts, why not compare Jobs to Gates? Cook visits the factories once, and he's a saint, but when Gates donates millions to charity its a sign that he doesn't care about making a good product as Jobs would word it.

      this many violations and the punishment is just to correct them? they more than doubled the legal overtime limit, forced employes to work weeks with no breaks, didn't report any work related accidents that didn't stop production ( aka only accidents that stop/break the machines ) which could be anything.. who knows what wasn't reported. and what ever else laws they broke, and the factory's aren't getting shut down......? no one is going to jail.....? there isn't a huge fine they have to pay...? correct me if i'm wrong but anywhere else in the world there's no second chance for so many violations and broken laws... so wheres the punishment?

      This report is so bias. Many do not realize that these "overtime" are wanted by the employees themselves! Yes! They want the OT work. They are poor and they have nothing to do once they go back to the dorm. So they work. How I know? Because my friend have a swimsuit factory here and a lot of people stay late just to get more work done since they are paid by the pieces completed.

      You people really need to stop all this bullcrap about them being not treated fairly because it is obvious that you all know nothing about the conditions here.

      There are 1.3 billion people here in China. These people are lucky that they have a god damn job. There are always people lining up outside Foxconn waiting for a job that pays well, have insurance, in an air conditioned environment, and it's clean! You can't say that for the other 99% of the other factories in other industries. My friend's factory workers have to endure 90+ heat and 80% humidity conditions in the summers with only fans and opened windows! The office workers there only gets paid 1500/mo and they are college grads! Compare to that, Foxconn workers have it good...

      Most ignorant comment of the day. Have you thought about what if they did an inspection of the other factories? There's NO comparison as far as outsiders are concerned.

      Most people think they are underpaid here in China. You know why? Because there are a lot of god damn people here. Imagine there are 4 times a many people in the states. Simple supply and demand dictates that wages will be lowered because people would rather have a job then not.

      These people get paid more then college grads! Do you thing that's fair that these people have zero education and can get a job paying more then someone going though 16 years of school?

      All "problems" they claim foxconn have other factories have it worse. Believe me, if investigations were done at other factories, Foxconn will seem like heaven.

      I would like to say that I worked for a company here in the good ol' USofA, and they had more violations than that. The company is very large and well known, and it was cheaper for them to pay fines than make the corrections. It is still business as usual, and the violations continue.

      Despite the fact that China has a much larger population, they have a LOWER unemployement rate. So, by YOUR OWN analysis of how things work, that means that American's should be getting paid what the Chinese do, and vice-versa, since so many more Chinese are employed than Americans. Yet, that isn't the case.

      But wait...'now' there has to be proof of changes??? Apple has done their part in citing the company for its violations. It's up to the company to implement these changes. The FLA is larger than just Apple so it's up to them, not Apple, to enforce their regulations.

      So many of u are quick at tongue-lashing Apple yet you're still using their products. I, for one, do not agree w/ everything Apple does but obviously they are doing something right! Right???

      I agree, they're at least do something to help! Can't say the same for all the other companies that get their products made there. Apple can only do so much, the rest of it is up to Foxconn.

      Another thing you don't know about China. Because of the one child policy, there are hundreds of thousands (maybe millions) of people here that are not 'registered'... meaning they have no 'green card' so they are not counted in the study. You see, even with the one child policy, many still choose to have more then one kid, but most can't afford to pay the stiff penalty. The child can be born but they won't be able to obtain a 'legal' status. There are ways to get status but that, again, requires money. A lot of factories employ these people because they take lower pay, and that of course, comes with crappy working conditions. Foxconn's conditions are so good (comparing to other factories) that even though they can only hire legal workers, there's still a line outside everyday!

      Do you think the illegal immigrants in the US are counted in any employment study? Probably not as that would mean the government will know who is hiring them.

      Another thing I want to add is that nowhere in the report says that these workers were FORCED to work OT or 7 days a week. I live in Guangzhou and its one of the most expensive cities here in China. Here are some comparisons that I personally have observed: foot massage workers get paid about 1500/mo working 6 days a week 10-12 hour shifts. They average about 5-6 patrons a day with 70 min per patron. A restaurant waiter gets about 1200/mo working 6 day, 10 hour days and no tips. Wholesale market worker bees gets paid 800-1200/mo, 7 days a week with 2 days off a month. Professional spa (massage, facials, beauty treatments) workers gets 2000/mo, 6 days a week, 8-12 hours a day depending if there are customers that come late (which according to my wife, they usually do). Avg college grad gets paid 1800-2500/mo working normal office hours. (all numbers in RMB of course). So how are these people getting by in a big city?

      These Foxconn workers are getting paid more then the average worker here in the big city! And they get benefits! What I learn is that the Chinese are good at making themselves look 'poor' and make others feel sorry for them. They put on this drama act when asked about how they are. These people are taking things for granted. They won't realize how good they had it until the second they are fired.
