  • German Court Close to Ruling in Favor of Motorola Mobility in Patent Case Against Apple

    A German court is extremely close to ruling against Apple and in favor of Motorola in an iCloud related patent infringement suit.

    According to Florian Mueller of FOSS Patents, Friday was a horrible day for Apple as the court appears to not believe any of Apple’s arguments. Mueller is confident if the court had to rule Friday they would have ruled in favor of Motorola mobility. The lawsuit revolves around European Patent 0847654 (B1) “Multiple Pager Status Synchronization System and Method. It’s the equivalent of the U.S. Patent No. 5,754,119.

    Mueller seems convinced the biggest issue for Apple is any device utilizing iCloud would most likely be infringing on the patent and come under scrutiny.

    “The issue for Apple here is that it would probably (if not almost certainly) be accused of infringing the patent-in-suit with any products containing the iCloud client software. While the patents covers a synchronization technology that requires a server, and Apple Sales International does not operate the servers (maybe Apple Inc. does, or otherwise some subsidiary other than the Irish distribution organization), all Apple devices containing the client software could be deemed to infringe the patent-in-suit contributorily." — Mueller
    Apple has asked the court to set a bail of roughly 2 billion euro or $2.7 billion. This bail amount is necessary to ensure that if an injunction is put in place and later over turned they are compensated for sales lost. If the complete range of Apple can't be sold for an extended period of time the $2.7 billion could be on the low-end of the bail estimate. Especially considering how important the German market is to Apple in Europe.

    It appears Google’s acquisition of Motorola Mobility is already paying off.

      Yeah well, maybe if 95% of the products out there didn't resemble or steal ideas from Apple and called it "innovation," Apple wouldn't have to sue companies.

      LOL! seriously? In the technology industry, everyone steals from everyone. It goes both ways, up and down, sideways, crossways whateverways you can imagine.

      It's easy to hate on every company cause they are all looking to sit in the limelight of apples shine but yet presume apple is a halo in the sky simply because they were the first to create such a "market". It all comes down to Apple looked at the current market and asked themselves how do I make this better and they created a better product. They built upon a pre-existing foundation and made themselves shine. It's good that companies like motorola are winning battles against apple cause when you "re-invent" something you essentially "stole an idea and made it better" which is the criteria that apple looks for when they go after everyone else for trying to "re-invent" apples success by taking their ideas and further trying to build upon them.

      Kudos to Motorola, I hope more companies stand up and win court cases, make apple realize you can't survive by stifling innovation but have to continue to forever out innovate any competitor.

      Foundation? Really? Please look at what the "market" was like before Apple introduced the macs, ipods, iphones, and ipads. I don't see them blatantly ripping off crap from other companies. They are ORIGINAL innovators, not like Google, who rips off every single thing it set's its eyes on. (Except for it's search engine) And I'm sure you don't understand, so here is a little picture to demonstrate what I mean,

      Get it? If they made something better, it was original, not some look alike piece of crap. There is a difference between INNOVATING and STEALING. I totally understand there should be competitors, and windows is a good one, they have their OWN mobile operating system which was not stolen off of IOS (its a different story with PC windows), and it's own different and unique look and feel. I don't understand how you think Apple steals ideas to make a better one, if that was the case, their product and operating system would look like the previous releases but with better hardware, much like what Google (android), and it's affiliate manufacturers are doing right now LOOL.

In some cases they do but look at how many apps/ideas they have used in newer versions of iOS. Many of the "ground breaking features" they implemented were rejected apps that later showed up on Cydia/Rock ect. Did they innovate those or steal those ideas? So take a breath, put the kool-aid down and understand Apple has stolen just as much as any other electronics company. I had palm pilots with a touch screen before iPhone even existed........ So did apple make the touch screen?

Yep, apparently you have a magical ball knowing that Apple must have not known about those ideas/apps already. Derp, perhaps they wanted to make an official app which doesn't destroy their device? Does that mean they stole it? Or does that mean they were working on it? Or perhaps, they took user suggestions and polls to see what people wanted?
      Touch screen? LOL. This is what makes you seem like an idiot. Let me clarify for you, Apple didn't make the TOUCH screen, they reinvented and revolutionized MULTI TOUCH technology. There is a clear difference between pressure sensitive touch screens and multi touch screens. Apple did this, they were the first, and look what happened? Every other device out now, has the same multi touch technology which first made Apple popular. (You remember the early laggy and ****** Android devices, which magically now have stolen features from the iPhone + Android software itself? Remember the gyroscope?) Stop sucking on cheap Android Di*ks, and get a real user intuitive and user friendly phone.

      Apple definitely qualifies as an "innovator" of technical products. What is more important, though, isn't whether Apple innovated or not it's that they are in the game. I think we can all agree if it weren't for Apple providing very stiff competition for everyone else then Samsung, LG, Microsoft, RIM, Nokia, etc. wouldn't be trying to come up with better products since Apple pretty much set the benchmark.

      I think this is pretty accurate because of all the iPhone Killer claims we have heard in the past about products that failed to live up to this moniker.

I don't have a windows phone, or an iPad, but most of my friends do have an iPad, and 2 of them have a widnows phone. (I've had the chance to use them for many hours)
      But I do have an HP Touchpad, Toshiba Thrive, iTouch 4G, Iphone 4, Blackberry Curve, Kindle, Blackberry Pearl, (1 other blackberry dunno name), Dad has Droid 2, LG Thrill 4G (provided by work), and various other symbian phones.

      Do you want to know which of these devices I liked the most? Which were the more user friendly and actually "fun" to use?

      After that maybe LG Thrill, because I really did like the 3D feature on it but nothing else. Honeycomb on toshiba thrive sucks, I mean whenever you can't control what applications you see and can open, and have a task manager type system to close your apps, then you KNOW something is wrong. Honeycomb shows you thumbnails of applications already open, (even if you close the applications, the thumbnails are still there, so if you want only calculator, and brower open, there will be many other applications getting in the way of that UNLESS you restart the device. Unlike WebOS and iOS, you control exactly what you want open and what you don't, without it being a huge pain in the ***.

      Lol @ this guy. Most of those are ********, like I said earlier on. Like really, 'Apps themselves', LOL. I guess the developers made the App Store, too. Wifi sync was NO WHERE perfect from the jailbreak community and Apple held back on this due to iCloud and making a huge data center, and they released all these features in one go, if you didn't know.

      Ok kid. Apple is the all and all in mobile technology. They are the best in everything..computers, tablets, phones. Infact, they invented the internet. Happy now Now, you can go to bed before you have a heart attack at your young age. FYI, Apple gives no **** about you.

      Hopefully apple will loose and go back to what its best at , developing cool products for us apple fans , at the moment most people just think of apple as a sour apple , if a product from apple is being beaten then apple should bring out a newer product ( not a 4s type of poor upgrade ) that kicks the competion in the butt , which is what everyone wants , if apple make a must have product and then the competition do the same , this keeps the inovation going , all these ******** court cases are boring and bad for us the end consumer ,

      Ok kid, yep. Gyroscope first on any mobile device, pinch and zoom, App store (Market LOL?), multi touch, etc all invented by someone else apparently.

      That is true, Apple started this mess and as a result, I boycotted Apple products choosing the Galaxy S II over the iPhone 4S. but all these lawsuits have to stop because in the end, the real losers will be us, the consumers.

      What can I do to make you know that I agree with you that Apple is the master innovator. You have won the battle..Apple is supreme. You can rest now while we android users (hate the word fan) continue to use our sub-par device that has infiltrated the mobile market with inferior and stolen ideas..we love it anyway and I bet you love your iOS too. FYI again, these companies give no **** about you and ME. So, let go of the idroid fight and enjoy your life. Devices are not suppose to make you happy..they are suppose to serve you like SIRI.

      Hope you know I'm being sarcastic...
