  • Motorola Wins Injunction Against Apple in Germany, Apple Can Still Sell Their Devices

    Foss Patents broke news about Motorola possibly winning an injunction against Apple products in Germany. If true it would be a huge blow to Apple’s presence in the European market.

    Good thing for Apple it's not.

    Motorola did in fact win an injunction against Apple in a regional court in Germany. The judgement does not mean Apple can be kept from selling the iPhone and their other products as the suit takes aim at Apple Inc. and not their local subsidiary in the region.

    The default judgement Foss Patents posted was handed down by the Mannheim Regional court in Germany and granted the injunction based on rulings that Apple infringed on two of Motorola’s patents. Both patents are European with one describing a “method for performing a countdown function during a mobile-originated transfer for a packet radio system" and the other a “multiple pager status synchronization system and method.”

    "This is a procedural issue and has nothing to do with the merits of the case. It does not affect our ability to do business or sell products in Germany at this time." — Apple spokeswoman Kristin Huguet
    Both are incredibly vague and likely essential to the functioning of most mobile phones which would result in a FRAND licensing agreement with Motorola. If it becomes more than that, kudos to Google for purchasing Motorola Mobility.

      At this point is there really anything "new" in the electronic community..... It would seem no matter who you are you're going to be stepping on someone's IP no matter what you make.

      which is why patent reform is necessary, fan boys don't realize that without sufficient competition, we the consumers are the losers in all this.
