  • Openwave Seeks Ban on All iPhone, iPad Imports in New Lawsuit


    Openwave Systems has filed suit against both Apple and Research In Motion for allegedly infringing on the company's intellectual property and associated patents. According to Bloomberg, Openwave filed complaints with the U.S. International Trade Commission and in federal court in Delaware.

    Openwave asserts that two smartphone pioneers have mutually infringed upon at least five of its patents. The violated patents in question supposedly relate to the ways in which mobile devices (phones and tablet computers) connect to the Internet. As part of the complaint, Openwave is requesting that all importation of Apple's iPhone and iPad be blocked immediately.

    Although the request doesn't appear likely to be granted, we have to keep in mind that Apple has previously succeeded in getting its competitors' products blocked from importation as well, even if for only a short while.

    “There are people in the world who deliver products into the market that are leveraging our patented technology,” Openwave Chief Executive Officer Ken Denman said in a statement released to the media. The inventions are “foundational to the mobile Internet and we believe it’s only right we get paid for the use of our foundational technology.”

    Prior to filing suit, Openwave admits to having reached out directly to Apple and RIM, yet neither party apparently responded in a manner that was sufficient or consistent with Openwave's request for compensation.

      So when Apple sued Samsung over the look and feel of the ipad and iphone, that was justifiable? Perhaps in Apple land but back here in the real world, that's ********.

      I think you fail to understand that Apple tends to be the 1st company to file the lawsuits over stupid things. So then everyone else fires back.

      I think you fail to understand that Apple tends to be the 1st company to file the lawsuits over stupid things. So then everyone else fires back.
      The reasons a big company like Apple or Samsung engages in patent suits is very different than the reason a small company like Openwave sues.

      Its no longer ELE (everybody love everybody) but instead ESE (everybody sue everybody)

      Apple when ran out of ideas starting thinking of capping the market by suing other companies and shut them. They started it so face it now. They stole ideas from developers apps and then made it their own and then rejected their apps pending approval for many than an year. Well, they have the discretion and that we have "Terms & Conditions" for written in small tiny letters.
      Also I do believe that Apple did infringed the patents. Its just that they have so much cash they can afford lawyers and lobbyists they are getting away with it. Hey, isnt this what our corporate American culture is?
