  • Apple Gets Samsung Galaxy Tab Blocked in Most of the European Union


    In what can only be regarded as a major victory for Apple on the world stage, German news agency DPA is reporting that Apple has been granted a preliminary injunction against Samsung's Android-based Galaxy Tab 10.1. As a result, the tablet is effectively barred from distribution across all of the European Union, sans the Netherlands (for now, at least).

    In light of Apple's allegations that the Galaxy Tab is a blatant iPad rip-off that subsequently violates Apple's intellectual property, the legal eagles in Cupertino went to Europe with their calls for Samsung to play fair or pay the price.

    Apple asked the Landgericht (district court) of Düsseldorf, Germany, to order an injunction under which Samsung is threatened with fines of up to EUR 250,000 (US$ 350,000) for each violation or imprisonment of Samsung's management in the event of continued infringement. Those are standard sanctions under German tort law for contempt of a preliminary injunction.
    In addition to Apple's successful legal power play in the European Union, the company is also said to be seeking a comparable preliminary injunction in Australia. Although Apple is yet to win that one, Samsung is being proactive about the matter and, at least for the time being, postponing the launch of the Galaxy Tab 10.1 in Australia with no estimated future date for launch given.

      I'm gonna laugh when there are no competitors left and apple is complaining that there is no nobody to sue. Mmm, if that happens maybe they'll sue themselves.

      WOW! What is original and what is not is the question? I mean technology is copied daily but when it comes to phones it seems that too close for comfort=LAWSUIT! I'm all about being original and all of that but come on...companies are spending more time in court rather than more time in the lab creating new products for us consumers to revel about! I love Apple and the products they design...if the opposition so to speak is not playing fair...i would sue them as well

      I never said they were perfect, but you do agree that they are light years ahead of the competition. They did not get to the top by copying smart covers..I just tried to enlighten you on the accessory game is no big deal compared to an OS, that's all. If i was straying off topic it's no different then your samsung sales facts you stated. I'm sure the moderators/forum goers would of spoke up about this if you or I were straying off topic. Its all relevant. This article is about apple being granted an injunction on samsung's "tab" not samsung being granted a injunction on the iPad. I'm done arguing, we sound like children. You made your points i made mine and we will leave it in the hands of the modmyi community an the legal system..

You should give apple some credit considering they got screwed from day one only to flip the game and now they run the show. If you have a nice Mac and a pc and you use the pc more something is wrong. If u own just a Mac or just a pc then your defending your computer. I own both and I can say never touch my pc any more.
      So let's settle this once and for all......in your HONEST opinion.....is the Samsung Galaxy Tab a blatant near carbon-copy rip-off of the iPad/iPad2?? Not a "resemblance", a rip off.??

      I think the interface of the two are very similar, blatient rip off idk about that. I think that samsung thought they were going to get away with it considering they supply apple a lot of their hardware, more then any one els. I think apple stood their ground thinking if samsung cut them off for suing them they then could bypass samsung by going through samsung's supplier SEMCO. I think apple may be a lil traumatized from the events that unfolded back in the beginning of the computer era, vowing that would never happen again by no means. Just my opinion though.

      These are without a doubt sad times for consumers. I will say that Apple has a high quality product with a fairly seamless software experience. That being said, they aren't really in the business of innovation(at least in software) like people seem to think they are. They constantly rip-off features from the jailbreak community and call them their own to the point that it is almost laughable.

      I haven't been an iPhone user for a while now and this type of behavior will ensure that I don't come back. I have a first generation iPad and iPhone 3gs that I use sometimes for debugging games that I'm working on. I even have a Macbook Pro that I use to develop with, but I have easily 3 android/windows devices for every Apple product I own. As a software developer I have to also mention that when devices are dictated by a single company(Apple) your games/software will suffer also. Once they don't have to include the latest-greatest chipsets because there is no one to compete with the consumers will get lack-luster games and apps.

      I wish that people would open their eyes and realize that consumers WIN when there is competition between companies. This isn't a debate about what products are better, because that is completely subjective and based on what people use their devices for. I rather enjoy having faster chipsets for less money(Tegra 2/Kal-El), but I guess some people like the social status associated with a little apple logo more than actual performance. There have been a good many points in this thread that were logical and well written, but for each one of those posts comes five ignorant rants. Oh well, what 'ya gonna do?

      Are you serious? Honestly, a screen full of icons with text labels was hardly a new idea. Neither was folders containing more icons. Or have you never looked at the desktop on a Mac, PC, or others in the past two-plus decades? How can this be a criteria for calling someone out on infringement?
