  • HTC Catches Feelings, Says Apple Would Rather Sue than Compete Fairly

HTC is taking the disappointed parent round in their official response to Apple's latest complaint filed with the International Trade Commission in which Apple requests the blockage of HTC imports.

HTC is disappointed at Apple's constant attempts at litigations instead of competing fairly in the market. HTC strongly denies all infringement claims raised by Apple in the past and present and reiterates our determination and commitment to protect our intellectual property rights. - HTC general counsel Grace Lei
This isn't the first time Apple has sued HTC. In March of 2010 Apple accused HTC of infringing on 20 patents involving the iPhones user-interface. However, the response from HTC wasn't the typical "Sue me? Sue me? Fine, I'll sue you!" response that has been prevalent between mobile technology companies. HTC appears to be trying to take some sort of moral high-road, or they simply don't have the legal and patent firepower to enter a litigation battle with Apple.

The Nortel patent auction deal led by Apple was officially approved this morning by both the U.S. and Canada, which is sure to add fuel to Apple's Agent Orange bombing patent strategy. Even if HTCs words do somehow ring true with Apple, its going to take a lot more than the disappointed words of a parent to change the mind of a child. Especially when that child is a wildly successful company with $70 billion in cash reserves.

I hate to play devil's advocate when people badmouth Apple like this but let's face it. The iPhone and iOS MADE everyone else come out with better stuff by the sheer fact that it was intuitive and organized well plus it is a very nice UI to look at.

Without Apple doing this who knows what sort of crap we'd be forced to use by RIM, Nokia, HTC, etc.

Remember the original iPhone came out in 2007 whereas the T-Mobile G1 which was the first U.S. market Android device came out in 2008.

So Apple forced the competition to create better products by creating...a better product.

I still don't think the ITC should ban imports of HTC phones nor should Android be taken down. I don't see Apple suing Microsoft over Windows Phone 7 or suing LG over the Optimus-series Android smartphones.

Competition is good for the market.

The technology was there but no one had the vision to do it and still havent encountered a phone that runs as smoothly as the iphone does. So please HTC and google stop pretending that you were days away from launching anything that resembles the iphone because you all copied them (i know its not illegal) but stop pretending that you came out with the idea first
Have you seen the new ios 5 demos? The new and innovative slide down status bar.... yeah no one has ever seen a slide down status bar for notifications before. Apple copies everyone they can including the hardworking developers that submit their stuff to cydia instead of the appstore. The only difference between apple and google is that google made they're OS open source and apple did not so they copy what isn't patented and patent it for themselves. Nobody is the good guy in these situations, it's just whoever has the bigger stick and if they're greedy enough.

Just because you believe that android is inferior does not make it so. The only real advantage of the iphone at this point is the fact that they have a hella ton of games and random stuff on the appstore. Android is almost fully customizable and if you have a current model, has very little lag if any. I'm not taking sides, seeing as I have both ipads and the new ipod touch and around 5 android phones. I'm just informing all of the people with aurguements that I find funny and uninformed. [/QUOTE]

I completely agree with you on how apple steals features and implements it into their devices and claims to have "innovated" or "created" it themselves. I got so mad when i saw them demo the wifi sync feature of iOS5, because not only did they steal the feature from a jb dev, but they stole the name and the icon too. I love using iOS devices just since i am more used to them and i love cydia, but every good feature in iOS has either been stolen from a cydia/jailbreak developer, or another mobile OS. HS wallpaper, multitasking, MMS, App Store, improved notifications... pretty much everything people love about iOS was created by individuals, NOT apple devs

It is what it is. It's not all bad if people still want Apple products. Kinda like Wal-Mart, it's not fair to it's employees, it's taking over the world, but it's just so darn convenient to shop at

it's things like this that make me hate the reporters on this site. HTC are a multinational corporation (which is doing very well), of course they can provide top notch lawyers, and they wouldn't bother counter-suing if they didn't have sufficient means to do so.

apple is the ******* of the tech world, and HTC was just commenting on this (it's what everybody has been thinking)

      EXACTLY!
EVERYONE said what $ony did when they sued people was the wrong way to deal with what happened and it looks like crApple are following in their footsteps and instead of playing fairly they sue people.

Thats the fastest way to loose friends. I'm guessing HTC will now team up with Micro$oft and crApple will wonder why they are losing in the phone market. ITS COZ YOU SUCK crAPPLE!

Thats the problem with the iPhone and iPad. It's owned by crApple. If it was made by anyone else it would be the number one phone/tablet on the market but people don't like crApple so its not number one and it will never be.

Translating that quote from HTC it pretty much says that they think Apple is full of sh!t, and are sick of their crap and basically just called out Apple in a market duel.

Of course Apple would rather run to mommy (the courts) instead. Real quick to brag about themselves when they smoke this product and smoke that product and break sales records easier than people break their iPhones.....but when someone presents a legitimate competitive threat or starts gaining ground/pulling away, then all of a sudden it's because they cheated and copied Apple.

You know you've got problems when you've been in so many lawsuits and patent wars that your patent lawyer (who im sure was making some serious cheddar) finally snaps and dips out of there with the quickness.

i suggest HTC calls apple up and strikes a deal before they get banned from selling their products in the US which is all apple really wants is for them to pay royalties

Its funny that the only buggy p.o.s devices we have are our two (Jailbroken) iphone 4's. if they had half the features available to Android phones, we wouldn't have to jailbreak them now would we?

And if you'll never go back to Windows, lemme ask you sumptin' I'll bet your shinny new mac is useless without Bootcamp.

the iphone needs to be jailbroken to address its multitude of shortcomings and make it a more usable device., Mac OS needs Bootcamp to address its multitude of shortcomings and make it more usable.

hmmm, I see a pattern of failure here.

Sell your iPhone now and get an Android, the resale value of your iPhone will likely cover the cost of an Android without a contract, wouldn't it?

I think it's a bunch of crap, apple has a stick shoved so far up their arse it's crazy! I think companies should be able to copy whoever they want, it's only gonna benefit the consumers. If htc can make a handset that's similar to the iPhone but yet can operate better and cost is less then more power to them! Maybe apple should stop being so damn up tight and controlling, and stop trying to take every last cent they can get out of everyone.

I couldn't agree with you more. Apple gave the other manufacturers the kick in the pants it needed to get working on better stuff. That still doesn't mean Apple should be able to eliminate competition by frivolous lawsuits. They already seem to be beating out the competition. Why not do it fairly?

You mean like the iPad 2 with dual core processor??? Or r u talking about phones?

Here is the deal... Most apple iPhones and iPads work better with lower specs than most of the android competition with faster processors and more RAM. Take the Zoom for an example. I tried that out since a friend of mine has it and it was laggy as hell. Not a show stopper but compared to my iPad 2....I will take the iPad. And the Zoom has twice the RAM.

Most of the android products seem to need the increased hardware specs to have a decent product to compete.

I just ordered a cheaper android tablet for my wife to play with since her laptop sucks. She surfs the Internet, listens to music, watches you tube, and watches movies. The tablet I got has android 2.2, 1Ghz processor, 512 MB RAM (the Flying Touch III). It isn't great but it will give me an idea if android is something I want to mess with at all or just stay away. For her it will work either way. At least until the next iPad comes out and she gets my 2. then the android can go to my daughter.

Either way I am excited to give the android tablet a try out.
