Geohot is no stranger to legal troubles. His latest problems with the law involve Sony suing him for violation of the DMCA, computer fraud and copyright infringement. They have been granted a temporary restraining order which “forbids him from distributing the jailbreak, helping or encouraging others to jailbreak, and distributing information they've learned during the creation of the jailbreak,” according to his Wikipedia page.
The courts have also ordered Geohot to hand over all computers and storage media used in the creation of any jailbreaking software to Sony’s lawyers. I know I would have a hard time handing over all of my computer equipment to a bunch of lawyers. In response to Sony’s allegations Geohot has posted his opinion on the matter on YouTube. Largely I believe in what you are saying. The console market is a strange one, however. They sell their hardware for less than or equal to cost with the assumption that they recoup this all on software.
I see a couple scenarios here:
1) we cause home gaming to nose-dive and people close shop (already happened to SEGA for largely these reasons - which is why they are solely a third party now).
2) Everything (and I mean everything) hardware becomes rented... sort of like DVRs are from many cable companies.
3) You sign a clause stating that you agree not to tamper with the copyright software (that is their true worry here, NOT that you are jailbreaking the thing)
Either way, it's clear that Sony is just trying to make an example of the kid. Bottom line is if people work on breaking down the walls of anti-piracy, these console makers are going to decide it isn't profitable enough for them to be in the market in the first place.
I agree. What's most likely to happen with these big companies though? I don't think ppl will want to rent phones or consoles, I don't see that going over very smoothly for some reason.
