  • Apple Forces Their Hand on iPhone Trademark. We are changing domains.
    Today we received a letter from the friendly legal team of Townsend and Townsend and Crew; Apple Inc.'s legal representatives.

    I'll just give you the summary:
    • Apple owns, through its Ocean Telecom affiliate numerous U.S. and international filings for the iPhone trademark U.S. Ser. No. 77/007,808.
    • Since the services we offer here on MMi are directly related to Apple's iPhone, Apple Inc. believes that ModMyI will inevitably confuse consumers into believing we are associated with Apple Inc., therefore infringing on Apple's Trademark rights.
    • Apple is concerned that ModMyI also dilutes and tarnishes the distinctive quality of Apple's famous iPhone mark.
    • We are not allowed to use the Apple registered Apple Design Logo No. 2,715,578 that is displayed on our links to several "iPhone Topsites," which are unauthorized third party websites.
    • Apple assumes that it is not our intent to create customer confusion. they are correct we are not trying to confuse people
    • Apple asks that we abandon the use of all domain names that have iPhone in them on this website and to agree not to use ModMyI or any other mark, name, domain name, logo, tagline, slogan, or anything else that contains iPhone for goods and services related to or competitive with Apple's iPhone or dilutive to Apple's trademark rights.
    • Apple further requests that all use of its product photographs and the Apple Design Logo immediately and permanently cease.
    Because of this letter ModMyI.com will henceforth become ModMyI.com. Also the iPhone Topsites links on the left of the site will be remove since they contain the Apple Design Logo (although that is not controlled by us).

    We will remain open and continue providing users with the same free services that we currently offer.

    The current addresses to different pages on this site will remain the same except the ph will become a f. For example http://modmyi.com/forums/ will become http://modmyi.com/forums/ and so forth.

    During our move users may experience short site outages but don't worry, we are not going anywhere and hope you will continue your support of this site under it's new name, ModMyI.

      While it sucks, It's a business move. You have to look at it from that perspective also.

      We're still here though, so they obviously accomplished nothing that gave them an advantage.

      Oh come on Apple! Itís pretty obvious that itís not the ďiPhoneĒ that you have a problem with. Itís the ďmodĒ in the name. You arenít making other iPhone websites like everythingiphone change their name, are you?

      You know, Iíll wonder if modmyi... scuse me... modmyi could sue for prejudice or something if Apple doesnít go after every website with iPhone in their name.

      I think you should definitely fight and countersuit them for harassment, here's how first of all it's considered an harasses and take a look at all these other website that apple don't say a thing to... examples = MacRumors.com, MacNews.com, MacFixit.com, MacThis, MacThat... and on and on and on...

      Why so much hate and talk about suing? If you are here it is because you like Apple and the iPhone, all they asked was for the domain to be changed. Who cares??? Everything is back to normal now, you just have to change your bookmark... It is probably pressure from AT&T anyway...

      wow! easy there fanboys!!! i can't believe all the negativity towards apple. ironic, that everyone buys their device.

      you would have to own your own company or product to understand i guess. but they're just protecting their intellectual property. i can't believe all the "send letters with F bombs" to apple. that's just pure fanboy sensationalism.

      Been here for a while - just asked a few questions so I'm not a newbie...

      This thread started as an acknowledgment of a letter received that this site was infringing on copyright (iphone name). The fact that everyone is going on and on saying that this website and its owners should rage against the machine is out of touch. There is nothing wrong with Apple protecting their brand. Just as if any of you had created something and then had another party come along and siphon off your name. Now I use this site and enjoy the ideas and links so I am not saying to shut it down. Just as Apple is not asking for it to be shut down. They just want THEIR content protected. THEIR pictures. THEIR name. They paid for it. They own it.

      Anyway... whether you like it or not - Apple is a billion dollar company.

      Just enjoy the fact that a site that shows you how to jail break and mod your phone exists!

      Not true. This has zero to do with intellectual property. It's about their stance against modifications to iPhones. If it was truly about intellectual property, then they would have been going after every website that has apple, mac, ipod, iphone in their name. There are probably thousands of websites by now that Apple would have to target, and they aren't going to do that. They are only going to target websites that encourage behavior that is against Apple's new fascist philosophy.

      Again, it's not fanboys that "send letters with F bombs" to apple. Fanboyism is essentially people that protect and defend Apple to the death at all costs. If you want to look at a "fanboy reply", read yours.

      Kinda of figured this would happen sometime, it's nice all they demand is a name change. I think that this link is pretty damn funny. I would consider co-locating to a Sweden company haha..

      I love the responses that these guys give and publicly post about these million/billion $ companies threatening them.

If it was truly about intellectual property, then they would have been going after every website that has apple, mac, ipod, iphone in their name. There are probably thousands of websites by now that Apple would have to target, and they aren't going to do that.       Fascism is hardly what Apple is doing. They are being more pejorative than anything.

      As far as fanboy behaviour - most of what is shown here is. That is a simple fact of a site that is all about geeks like us who want to mod the phone!

      wait a second correct me if i misread something a while ago but i dont think that apple owns the word "iPhone" "Iphone" i thought that linksys owned that and apple tried to sue but lost.... But then again that was a whiles back?

      Except they didn't have the legal right to do that. Modifying our iphones isn't illegal. And it's CERTAINLY not illegal to give out information on how to do it... free speech and free press and alla that.

      Wikipedia has a great definition for fanboy:
      "fanboys are attributed with a sycophantic devotion to the creators and principles behind a work with which they are currently enthralled."

      So fanboys, by definition, don't mod their iphones. Fanboys do what Apple tells them to do, and they fight people that do mod their iphones.

      Apple locked their system out from modders and third party developers.FACT symbian,uiq,wmobile all of these phones have an open system that you can program into.APPLE need to understand as we are the buyers of their products we demand more.I am not spending money on a simple Phone.Ok heres my lineup:n95,u990,k850,t mobile ameo,e90,p990.Because of this web site i bought an iphone and even tho it doesnt match in anyway the e90 or the ameo aka advantage it is my fave phone.If it wasnt for the hacked 1.1.1 then i would even bother looking at the damn thing.APPLE WAKE UP.

      VERY smart of you. This is not surprising. The biggest battle Apple sees right now is unlocking/modding of the iPhone so of course they will directly target anyone having anything to do with it.

      Plus trademark protection is very common and makes sense. It won't affect the site in the least. I'm happy that's ALL they asked you to do.
