Samsung's Requested Product Ban Applies Only to Older iOS Devices
Capping off a busy week of legal news for Apple and Samsung, the latest filing by the South Korean tech behemoth with the U.S. International Trade Commission is bringing to light critical details regarding Samsung's request for a market ban on certain Apple products.
According to FOSS Patents, Samsung has indicated that Apple's alleged patent violations largely apply to previous generations of Apple products. Consequently, if a ban is granted, it would only impact older iOS devices like the iPhone 4, iPhone 3GS, and iPhone 3, in addition to the first two generations of Apple's iPad.
This information is critical to understanding the prospective scope of a potential import ban. Given that the iPhone 3GS, 3G and first-generation iPad are no longer rolling off of Apple's assembly lines like newer models are, that leaves Apple with only a potentially serious market loss of the iPhone 4 and iPad 2 if a ban is ultimately ordered - and that's a big "if" indeed.
